TERMS & CONDITIONS

By signing up for and/or attending classes, sessions, events, activities, and other programs and using the premises, facilities and equipments (individually and/or collectively, the "Classes and Facilities") of DAYR Studio, you hereby acknowledge on behalf of yourself, your heirs, personal representatives and/or assigns, that you have read, fully understand our terms stated in this page and voluntarily agree to be bound by it.

HEALTH WAIVER

By signing up for and/or attending classes, sessions, events, activities, and other programs and using the premises, facilities, and equipment (individually and/or collectively, the "Classes and Facilities") of DAYR Studio, you hereby acknowledge on behalf of yourself, your heirs, personal representatives, and/or assigns, that DAYR Studio shall not be liable for any damages arising from personal injuries (including death) sustained by you or your guest in, or on, or about the premises, or as a result of the use of the equipment or facilities, regardless of whether such injuries result, in whole or in part, from the negligence of DAYR Studio.

You acknowledge that there are certain inherent risks and dangers in fitness activities and the use of exercise equipment in association with the Classes and use of the Facilities. You acknowledge that some of these risks cannot be eliminated regardless of the care taken to avoid injuries. You also acknowledge that the specific risks vary from one activity to another, but range from (1) minor injuries such as scratches, bruises, and sprains; (2) major injuries such as eye injury or loss of sight, joint or back injuries, heart attacks, rhabdomyolysis, and concussions; and (3) catastrophic injuries including paralysis and death.

You hereby acknowledge that you are voluntarily participating in the Classes provided by DAYR Studio. You understand that these activities involve physical exertion and may include, but are not limited to, stretching, strengthening exercises, and the use of Pilates and/or aerial equipment. You are aware that Pilates and/or aerial exercises may require physical exertion, and you represent and warrant that you are physically fit and have no medical condition that would prevent your full participation in the Pilates and/or aerial classes and sessions provided by DAYR Studio. You shall, at all times, comply with all stated terms, guidelines, safety precaution signs, rules, and verbal instructions given to you by staff and instructors during and outside of any of our Classes to ensure that your risk or injury or discomfort while participating in a class is reduced.

DAYR Studio and its instructors are not medically trained and are therefore not qualified to assess whether you are in good physical condition and/or that you can engage in active or passive exercise without detriment to your health, safety, comfort, or physical condition. You are advised to seek medical advice prior to commencing any exercise program if you are in any doubt of your ability to do so. Participating in any form of exercise or the Classes at DAYR Studio is done entirely at your own risk. You acknowledge that DAYR Studio has recommended that you obtain a medical examination from a qualified healthcare provider before participating in the Classes, especially if you have any concerns about your health, and you agree to do so at your own expense.

It is your responsibility to inform the instructor of any medical conditions, injuries, or physical limitations before each class. You will keep the instructor updated on any changes to your health status that may affect your ability to participate in the Classes. Examples include pre-existing injury, illness, muscle soreness/discomfort, or pregnancy, prior to commencement (“Medical Condition”). Where you have a Medical Condition, we strongly recommend that you seek approval from a medical practitioner to participate in any of our Classes. Participating in any form of exercise at DAYR Studio with a Medical Condition is done entirely at your own risk.

If in the subjective opinion of the DAYR Studio staff or instructors, you would be at physical risk using DAYR Studio’s Classes and Facilities, you understand and agree that you may be denied access to the Classes and Facilities until you furnish DAYR Studio with an opinion letter from your medical doctor, at your sole cost and expense, specifically addressing DAYR Studio’s concerns and stating that DAYR Studio’s concerns are unfounded.

You acknowledge that our instructors may use tactile cueing and adjustment methods or make physical contact with you for correction purposes in order to ensure that your Pilates practice is undertaken in accordance with known practice methods (“Practice Methods”), during Classes. The use of the Practice Methods is designed to maintain a safe and beneficial Pilates experience for you, deepen your learning of Pilates, and to grow your capabilities for Pilates practice. Participating and engaging in Practice Methods is done entirely at your own risk.

DAYR Studio and its Representatives will not be liable and exclude all liability under these Terms & Conditions, in tort, statute, or in any other way for all injury, illness, damage, or loss of any kind whatsoever directly or indirectly sustained by you in relation to participating in any Class or otherwise entering the studio. You hereby waive and release DAYR Studio and its Representatives from all claims from participating in any Class or from otherwise entering the studios.

In consideration of being allowed to participate in Pilates classes and activities provided by DAYR Studio, you agree to assume all risks associated with your participation. You understand and agree that neither DAYR Studio nor its instructors shall be liable for any claims, demands, injuries, damages, actions, or causes of action, arising out of or connected with your participation in our Classes. You hereby release, waive, discharge, and covenant not to sue DAYR Studio, its instructors, employees, and agents from any and all liability, claims, demands, actions, or causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by you, or to any property belonging to you, while participating in our Classes.

You have read this Health Waiver and Release Form and fully understand its terms. You understand that you are giving up substantial rights, including your right to sue. You acknowledge that you are signing this agreement freely and voluntarily, and intend by your signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.

"DAYR Studio" shall be read to include its directors, employees, contractors, agents, representatives.

STUDIO POLICY

STUDIO POLICY & ETIQUETTE

At DAYR Studio, we believe in creating a positive and respectful environment for all participants to enjoy their Pilates experience. Our Studio Policy and Etiquette Guide outlines the expectations and standards that contribute to a harmonious studio atmosphere. Familiarise yourself with the following guidelines to ensure a fulfilling and enjoyable studio experience:

1. Health and Safety:

​

  • Prioritise your well-being. If you have any pre-existing medical conditions or concerns, consult with a healthcare professional before participating in classes.

  • Inform instructors of any injuries, limitations, or changes in health status that may impact your ability to engage in Pilates activities.

​

2. Punctuality:

​

  • Arrive on time for your scheduled classes. Late arrivals may not be permitted, and this helps maintain the flow and quality of the sessions.

​

3. Attire:

​

  • Wear appropriate clothing for Pilates classes. This includes comfortable workout attire and grip socks for hygiene and safety.

  • Remove jewellery, watches, and accessories before participating in classes.

​

4. Studio Cleanliness:

​

  • Keep the studio clean and tidy. Put away props and equipment after use to ensure a clutter-free environment.

  • Pilates participants are responsible for wiping down mats and equipment after use.

​

5. Silence Mobile Phones:

​

  • Silence or turn off your mobile phone during class to minimise distractions and maintain a focused atmosphere.

​

6. Respectful Communication:

​

  • Interact with instructors and fellow participants in a respectful and positive manner.

  • Avoid unnecessary conversations during class that may disturb the concentration of others.

​

7. Booking and Cancellation:

​

  • Reserve your spot in advance for classes through our booking system.

  • Cancel reservations at least 24 hours before the scheduled class to avoid penalties.

​

8. Class Cancellation by Studio: 

​

  • In rare cases where we must cancel a class, we will notify all registered clients via the email address provided at registration 24 hours before the scheduled class time.

  • Class credits will be refunded in which clients may use to reschedule their booking. 

  • It is the client’s responsibility to regularly check their email and the class schedule to confirm class status. We will not be liable for missed updates due to unchecked communication.

​

9. Low Attendance: 

​

  • A minimum number of 2 participants for reformer classes and 3 participants for aerial classes is required for a class to proceed. 

  • If a class does not meet the minimum attendance requirement, we reserve the right to cancel the class and refund class credits.

  • Clients registered for a cancelled class will be notified via email at least 24 hours before the scheduled class time.

​

10. Replacement Instructors: 

​

  • In the event that the scheduled instructor is unavailable, we reserve the right to assign a qualified replacement instructor without prior notice to clients.

  • All replacement instructors are certified professionals who meet our studio’s standards of expertise and teaching quality.

  • We do not guarantee the availability of specific instructors for any given class.

​

11. Equipment Use:

​

  • Follow proper guidelines for the use of Pilates equipment.

  • Report any malfunctioning equipment to studio staff immediately.

​

12. Instructor Guidance:

​

  • Follow the instructions of instructors carefully, especially during aerial activities where safety is paramount.

  • Ask questions if you need clarification or assistance with any exercise or technique.

​

13. Personal Belongings: 

​

  • DAYR Studio is not responsible for lost or stolen personal belongings. 

  • Lockers are provided for short-term storage during classes.

  • Please remove your belongings promptly after each session.

 

DAYR Studio will not be responsible in any way for the safekeeping of your personal belongings that you bring into our studio and will not be liable for any loss or damage to your property that you may suffer at our studio. You are not permitted to use lockers within our studio to store personal items for longer than the duration of the visit to our studio. Items which are left in lockers within our studio at the closing time for the specific day and are not collected by the owner(s) will be held for 1 week after being found, following which they will either be donated to charity or otherwise disposed.

MARKETING POLICY

You understand that DAYR Studio may take photographs or videos during classes and activities for promotional and marketing purposes. You hereby grant DAYR Studio the right to use and publish such photographs and videos without compensation. Photography and video recording will not compromise the safety, focus, or comfort of participants during classes. Instructors and staff members will ensure that capturing promotional materials does not interfere with the quality of the class experience.

 

DAYR Studio retains exclusive ownership rights to all photographs and videos captured for promotional purposes. Participants will not have any claims to ownership or compensation for their appearance in these materials. Promotional materials, including photographs and videos, may be used across various marketing channels, including but not limited to our website, social media platforms, printed materials, and promotional events.

PLAN POLICY

1. Non-refundable:

​

  • All plans purchased at DAYR Studio are strictly non-refundable. Once a plan is acquired, the associated fees are considered final and cannot be reimbursed under any circumstances. This policy is in place to maintain fairness and consistency for all participants.

​

2. Non-shareable:

​

  • The plans are designated for individual use and are non-shareable. Each plan is tied to the account of the purchaser and cannot be transferred or shared with another individual. This policy helps in maintaining accurate records and ensuring that plans are utilised by the intended participant.

​

3. Non-transferable:

​

  • Plans cannot be transferred from one individual to another. Once a plan is purchased, it is exclusively associated with the account of the buyer and cannot be reassigned to a different person. This policy helps in preserving the integrity of the plans and prevents misuse.

​

4. Start Date Selection:

​

  • At the time of purchase, participants are required to select a start date for their plan. This allows for flexibility based on individual preferences and schedules. The selected start date marks the commencement of the plan's validity period.

​

5. Activation and Validity:

​

  • Once the plan is activated on the chosen start date, it becomes valid for the specified duration. The validity period varies depending on the type of plan purchased. It is essential for participants to be aware of and adhere to the plan's expiration date, as plans cannot be used beyond this period.

​

6. Duration Variability:

​

  • The validity duration of each plan may differ based on the type of plan selected during purchase. Participants should carefully review the details of their chosen plan to understand the specific timeframe within which they can access the services.

​

7. No Extension Beyond Validity Date:

​

  • Plans cannot be extended beyond their originally specified validity date. Regardless of the circumstances, once a plan reaches its expiration date, it is no longer valid for use. Participants are encouraged to plan their attendance accordingly to maximise the benefits of their purchased plans.

​

DAYR Studio aims to ensure transparency and fairness in the management of Pilates plans. Participants are encouraged to familiarise themselves with these terms to make informed decisions and to fully enjoy the benefits of their selected plans within the stipulated timeframes.

CANCELLATION POLICY

1. 24-Hour Free Cancellation Window:

​

  • DAYR Studio enforces a strict 24-hour cancellation policy. This means that participants are allowed to cancel or reschedule their booking at no cost if the cancellation is made at least 24 hours before the scheduled start time of their class or private session. This provides flexibility for participants to make adjustments to their schedules with ample notice.

​

2. Late Cancellation Definition:

​

  • Any cancellation made outside of the 24-hour free cancellation window is considered a late cancellation. In other words, if a participant cancels or reschedules their booking within 24 hours of the scheduled start time, it is classified as a late cancellation.

​

3. Forfeit of Credit:

​

  • Late cancellations result in the forfeiture of any credits associated with the booking. This policy is in place to encourage participants to honour their commitments and to ensure that reserved spots can be made available to others in a timely manner.

​

4. Purpose of the Policy:

​

  • The 24-hour cancellation policy is implemented to maintain the efficiency of class scheduling and to provide fairness to both participants and the studio. It enables better planning, ensures optimal class sizes, and allows for effective utilisation of studio resources.

​

5. Consideration for Instructors and Fellow Participants:

​

  • Timely cancellations provide instructors with an opportunity to adjust their plans, and it allows fellow participants to secure available spots in classes. Late cancellations may disrupt the flow of classes and impact the overall experience for everyone involved.

​

6. Booking Responsibly:

​

  • Participants are encouraged to book responsibly, considering their availability and commitment to attending the scheduled classes or private sessions. Being mindful of the cancellation policy helps create a positive and organised environment within the studio.

 

​7. Notification of Changes:

​

  • Participants should stay informed about any changes or updates to the cancellation policy. Any modifications to the policy will be communicated through official channels, ensuring that participants are aware of the latest guidelines.

​

By adhering to the cancellation policy, participants contribute to the smooth operation of DAYR Studio, fostering an environment where everyone can enjoy their studio experience without disruptions. It encourages responsible booking practices and promotes consideration for fellow participants and instructors.

LATE ARRIVAL POLICY

1. Strict Late Arrival Policy:

  • DAYR Studio enforces a strict late arrival policy, emphasising the importance of punctuality for the smooth functioning of group classes. This policy is designed to prevent disruptions and maintain the flow of the class.

​

2. Zero Tolerance for Latecomers:

​

  • There is zero tolerance for late arrivals. Participants are expected to arrive on time for their scheduled classes to respect the time and experience of both the instructors and fellow clients.

​

3. Restricted Entry Once Class Starts:

​

  • Participants will not be permitted to enter the room once the class has started. This is to prevent disruptions to the ongoing session and to ensure that the atmosphere remains focused and undisturbed for those who arrived on time.

​

4. Respect for Instructors and Clients:

​

  • Enforcing the late arrival policy is a form of respect for both our instructors and clients. It acknowledges the importance of starting and ending classes on time, allowing everyone to make the most of their scheduled sessions.

​

5. No Refund for Late Arrivals or No-Shows:

​

  • In the event of late arrivals or no-shows, class credits will not be refunded. This policy encourages participants to prioritise punctuality and be considerate of the impact that late arrivals can have on the overall class experience.

​

6. Impact on Group Class Dynamics:

​

  • Late arrivals can disrupt the flow and rhythm of group classes. By strictly adhering to the late arrival policy, DAYR Studio aims to maintain a positive and focused environment for all participants, ensuring that everyone benefits from the class.

7. Responsibility of Participants:

​

  • Participants are responsible for managing their schedules and ensuring they have ample time to arrive before the start of their scheduled classes. Being mindful of the start time contributes to the overall success of the class.

8. Communication of Policy:

​

  • Participants should be aware of and understand the late arrival policy. The policy is communicated through various channels, including the studio's website, signage, and direct communication with clients.

​

By upholding the late arrival policy, DAYR Studio aims to create a respectful and organised atmosphere for all participants. Punctuality not only benefits the individual participant but also contributes to the positive and cohesive experience of the entire group during each class session.
